 The Litigation Division serves as the City's principal litigators under the direction of the City Attorney.  Division members handle a mixture of simple and complex litigation and conduct most of the civil trial work in which the City is a party.  The Division recognizes that their client, the City of Boise, deserves aggressive advocacy, balanced with prudent advice when the Client's best interests are served by settlement, mediation, or other non-litigation resolution.

The Litigation Division handles a diverse variety of cases since it represents all of the City Departments and their legal issues.  The majority of litigation cases handled by the Division involves the City of Boise as a defendant.  State law claims against the City must be brought under the provisions of the Idaho Tort Claims Act, Title 6, Chapter 9, Idaho Code.

The Division participates in monthly Risk Management meetings with the City's Risk Manager, a third party claims adjuster, and various City Department representatives. The purpose of the Risk Management meetings is to address the various claims and lawsuits filed against the City. Decisions are made as to which claims should be paid, denied, compromised, mediated, or litigated. The City is self-insured up to $400,000 and carries insurance for claims in excess of that amount. As a result of, and in conjunction with, being self-insured, the Litigation Division handles the vast majority of the City's litigation, rather than referring the cases to outside counsel.
